Health care reform is significantly changing the landscape of employee benefits and compensation strategies. PPACA mandates that all applicable large employers offer their full-time employees the opportunity to enroll in minimum essential coverage under an eligible employer-sponsored plan. Full-time employee is defined as “an employee who is employed on average at least 30 hours of service per week”.
The regulators recognized that not all employees work consistent schedules and that some fall into a class designated “Ineligible” employees. An “Ineligible” employee is one for whom “based on the facts and circumstances at the start date, it cannot be determined that the employee is reasonably expected to work on average at least 30 hours per week.” The regulators created a safe harbor method for determining the average hours of an Ineligible employee using Measurement and Stability Periods.
